Terms of use

These terms are the agreement between you and Hey Cardboard when you use the Hey Cardboard app and website. By creating an account or using the app, you agree to them. If you don't agree, don't use the app. Our privacy policy explains what we do with your data. Questions go to deon@oh8digital.co.za.

Who can use it

You must be 13 or older to use Hey Cardboard. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

Your account

• Give us a real email address that you can read. We use it to sign you in and to reset your password.
• Keep your password to yourself. You are responsible for what happens on your account.
• One person per account. Don't share it, sell it or sign in as someone else.
• If you think someone else is using your account, reset your password and email us.

What you post

You own what you post: photos, pulls, trades, captions, comments, your profile and anything else you add. When you post something others can see, you give us a worldwide, free, non-exclusive licence to store it, show it in the app and on our website, and make the copies needed to do that. The licence ends when you delete the content or your account, except for copies other people already hold, such as a completed trade they were part of.

Only post things you have the right to post.

Zero tolerance for objectionable content and abusive users

We do not allow objectionable content or abusive behaviour in Hey Cardboard. That includes hate speech, harassment, threats, sexual content, graphic violence, and anything that targets someone for who they are.

• Report it. You can report any post, comment or profile from the app.
• Block them. You can block anyone. Blocking hides you and the other person from each other.
• We act within 24 hours. We review every report within 24 hours. We remove content that breaks these terms and ban the accounts that posted it.

The app also stops some words being posted at all. That filter is a backstop, not a promise that you will never see anything unpleasant.

What you can't do

• Break the law, or help someone else break it.
• Post content that is hateful, harassing, sexual, violent, or that infringes someone else's rights.
• Impersonate another person or business.
• Scam other users, sell counterfeit cards, or misdescribe a card you offer to trade.
• Spam, advertise, or post links to other marketplaces in comments and captions.
• Scrape the app, use bots, or try to get at data or accounts that aren't yours.
• Interfere with the app, overload it, or get around our limits or bans.
• Copy or resell our prices, catalogue or app as your own service.

Trades between users

Hey Cardboard helps you find trades and keep a record of them. We are not a party to any trade. We don't process payments, hold cards, ship anything, check that a card is real, or guarantee that the other person will do what they said.

Every trade is between you and the other person, at your own risk. Check the card, agree terms you are both happy with, and use shipping you trust. If a trade goes wrong, report the user so we can act on their account, but we can't refund you or recover a card.

Prices are estimates

The prices in the app are estimates, worked out from recent sales and listings on other sites. They are not an offer to buy or sell anything, and they are not an appraisal. Real prices depend on condition, timing and the buyer. Check before you buy, sell or trade on the strength of a number in the app. How we price explains where the numbers come from.

Subscriptions

Some features need a paid subscription. Apple bills it through your Apple ID, and Apple's standard licensed application end user licence agreement applies to your use of the app alongside these terms.

• A subscription renews automatically until you cancel it.
• Cancel at least 24 hours before the renewal date to avoid the next charge. Manage or cancel it in the Settings app under your Apple ID.
• Apple handles refunds under its own rules. We can't issue them.
• Deleting your Hey Cardboard account does not cancel the subscription.

Not affiliated

Hey Cardboard is an independent app. We are not affiliated with, endorsed by or sponsored by Pokémon, Nintendo, Creatures Inc., GAME FREAK inc., The Pokémon Company, TCGplayer or PSA. Card names, images and trademarks belong to their owners and appear only to identify the cards.

Ending your account

You can delete your account at any time in Settings. We can suspend or delete your account, and remove anything you posted, if you break these terms, if the law requires it, or if your account puts other users at risk. Where it is safe to, we will tell you why.

The parts of these terms that should last after an account ends still apply, including the trades, disclaimers and liability sections.

Disclaimers

We work hard on Hey Cardboard, but we provide it as it is. We don't promise that it will always be available, that it will be free of bugs, or that every scan, match or price is right. Keep your own records of anything that matters to you.

Limits on our liability

As far as the law allows, we are not responsible for indirect losses, lost profits, lost data, or anything that comes from a trade between users or a decision you made based on a price in the app. If we are responsible for a loss, the most we will pay is what you paid us for the app in the 12 months before it happened, or US$50 if you haven't paid us anything.

Some places don't allow these limits. If you live in one, they apply only as far as your local law allows, and nothing here takes away rights you have as a consumer.

Changes to these terms

If we change these terms, the date at the top changes with it. If a change matters, we will tell you in the app before it takes effect. If you keep using Hey Cardboard after that, you accept the new terms. If you don't, you can delete your account.
